1. Scope and Application

These Terms & Conditions (“Terms”) govern the use of the HighFive Contacts App (iOS and macOS) and the associated Website.

By installing, accessing, or using the App or Website, you agree to these Terms. If you do not agree, you must not use our services.

2. Services Provided

  • The App helps users manage and maintain personal and business contacts, birthdays, notes, and reminders.
  • Optional features include: iCloud synchronization, newsletter subscription, and gift suggestions (via affiliate links).
  • The Website provides information, blog content, and support contact.

We may modify, expand, or limit services at any time, provided this is reasonable for users.

3. User Account and Access

  • Some features may require an Apple ID and iCloud account.
  • Users are responsible for securing their devices and accounts against unauthorized access.
  • The App may not be used on jailbroken or rooted devices, as this compromises security.

4. In-App Purchases, Subscriptions, and Payment

  • Subscriptions and purchases are processed exclusively via the Apple App Store.
  • Payment details are processed by Apple; we do not store or access them.
  • Subscriptions automatically renew unless cancelled in the Apple App Store settings.
  • You can restore purchases using the “Restore Purchases” function in the App.

5. Use of the App and Website

Users agree to use the App and Website only in compliance with applicable laws and these Terms.

Prohibited uses include, but are not limited to:

  • reverse engineering, modification, or unauthorized distribution,
  • use of the App in unsafe, unlawful, or fraudulent contexts,
  • attempting to bypass security or licensing mechanisms.

6. Affiliate Links and Disclosure

Our App and Website may contain affiliate links, particularly via the Amazon Associates Program and Etsy.

Disclosure: “As an Amazon Associate we earn from qualifying purchases.”

When users click affiliate links, they are redirected to third-party providers. These providers’ terms and privacy policies apply.

7. Intellectual Property Rights

  • All rights to the App, Website, and content remain with idyation GmbH or licensed third parties.
  • Users are granted a non-exclusive, non-transferable license to use the App for personal purposes.
  • Reproduction, distribution, or public display requires prior written consent.

8. Availability, Updates, and Termination

  • We strive to provide uninterrupted access but cannot guarantee permanent availability.
  • We may update, modify, or discontinue features without prior notice.
  • Users are entitled to updates in accordance with applicable law.
  • We may terminate or restrict access if users violate these Terms.

9. Liability and Warranty Disclaimer

  • We are liable for intent and gross negligence. For ordinary negligence, liability applies only for essential contractual obligations (“cardinal duties”), limited to foreseeable damages.
  • Liability for damages from injury to life, body, or health remains unaffected.
  • We are not liable for damages arising from:
    • the use of affiliate links,
    • downtime of Apple services (App Store, iCloud),
    • misuse of the App on jailbroken/rooted devices.
  • We provide the App “as is,” without warranty of fitness for a particular purpose.

10. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).
  • For consumers with habitual residence in the EU/EEA, mandatory consumer protection rights of their country remain unaffected.
  • Place of jurisdiction for merchants and legal entities is Düsseldorf, Germany.

11. Changes to these Terms

We may update these Terms from time to time. Users will be informed via the Website or App. Continued use after changes constitutes acceptance of the updated Terms.
